Welcome to The Tin Hat Centre (We, Our and Us). These Terms and Conditions (‘Terms’) govern your access to and use of our website and services, including the services offered by the trainers through our platform.

1. Acceptance of Terms

• 1.1. By using The Tin Hat Centre, you agree that you have read, understood and are bound by these terms.
• 1.2. If you disagree with these terms and conditions, you must immediately stop using this website.

2. Platform Services

• 2.1. The Tin Hat Centre is an online platform where independent physical trainers advertise their services to platform users.
• 2.2. The Tin Hat Centre only provides space for advertising on the platform and does not guarantee revenue generation for any trainer in any circumstance but supplements their efforts by providing a stable, efficient and competitive advertising platform.
• 2.3. The Tin Hat Centre is an impartial domain controller and does not promote, recommend or emphasise any trainer’s services over another. All ratings and reviews will be determined by third party users and not The Tin Hat Centre.
• 2.4. The Tin Hat Centre may include links to other websites not controlled by The Tin Hat Centre and does not accept any liability or responsibility in regard to content shared or sold on those websites.

3. Terms of Use for “Trainers”

• 3.1. Individuals offering fitness services on The Tin Hat Centre are herein referred to as ‘Trainers’, to distinguish them from The Tin Hat Centre’s own operations, personnel and platform users.
• 3.2. Persons intending to use The Tin Hat Centre as trainers:
• 3.2.1 Must be at least 18 years of age.
• 3.2.2 Hold valid and current certifications or qualifications relevant to the sport or discipline you are advertising.
• 3.2.3 Be able to provide proof of qualifications upon request.
• 3.2.4 Comply with all local, state, or national regulations governing your profession.
• 3.3. Trainers operating on our platform are equally bound by these terms and must agree to our ‘No Data Collection Policy’ for any reason at all (See sec-tion 6 for further details on data collection, processing and storage).
• 3.4. Trainers operating on The Tin Hat Centre agree not to collect, process or store any data in relation to platform users in any circumstance. Trainers in breach of this clause shall be removed from the site and ordered to make reparations to the owner.
• 3.5. Trainers advertising their services on our platform accept all responsibility and liability for the contractual relationship between themselves and platform users.
• 3.6. Trainers must communicate professionally and respectfully.

4. Terms of use for “Platform Users”

• 4.1. Individuals using The Tin Hat Centre are herein referred to as ‘Platform Users’ to distinguish them from ‘Trainers’ and The Tin Hat Centre’s own operations and personnel.
• 4.2. Platform Users must be of 18 years of age or have parental consent.
• 4.3. All Platform Users agree to adhere to a ‘code of conduct’ when using our platform to interact with Trainers and our personnel.
• 4.4. The code of conduct refers to the set of rules given below.
• 4.4.1 Anyone using the platform shall do so in relation to activities regarding the provision of fitness services only.
• 4.4.2 The Tin Hat Centre does not accept any liability for any meetings arranged between Trainers and Platform Users for reasons other than that of provision of fitness services. Users are encouraged to take personal safety precautions and exercise care as necessary.
• 4.4.3 Platform Users are required to undertake their own due diligence on Trainers and their services that are advertised on The Tin Hat Centre and take into consideration their personal safety and such precautions as may be necessary in their own interest. Platform Users should take appropriate action when having concerns such as reporting to authorities and alerting The Tin Hat Centre.
• 4.4.4 Platform Users must communicate professionally and respectfully.
• 4.4.5 Platform users are not allowed to exchange any illicit, illegal or inappropriate content on our platform.
• 4.4.6 Platform Users should only contact trainers in regard to the provision of Fitness services only and nothing else. Any Platform user reported to contact trainers in relation to any other activity such as but not restricted to the promotion of products, services or businesses shall be banned from using our platform at our discretion.

5. No Data Collection Policy

• 5.1. The Tin Hat Centre has a strict no data collection policy.
• 5.2. The Tin Hat Centre prohibits the collection, processing and storage of any data that is available from the platform’s operations by anyone.
• 5.3. The Tin Hat Centre reserves the right to fine any individual using the platform in breach of these terms up to £50 and banning them from using the platfrom thereon.
• 5.4. Without prejudice to the above provision all users of The Tin Hat Centre should comply with the provisions of the Data Protections Act 2018 and the General Data Protection Regulations.

6. Trainer’s Obligations

• 6.1 Trainers are required to update their profile information and include updated data, relevant qualifications and experience.
• 6.2 Trainers are required to obtain and maintain relevant licenses, certifications and insurances as required by the law.
• 6.3 Trainers must conduct themselves in a professional manner with platform Users.
• 6.4 Trainers shall comply with all applicable laws regarding the provision of fitness services.
• 6.5 Trainers shall not harass, abuse or threaten any platform user.
• 6.6 Trainers shall not post any misleading information on platform spaces.
• 6.7 Trainers shall not promote competing or unrelated services.
• 6.8 The Tin Hat Centre reserves the right to remove any trainer from the platform when in breach of these terms and engaging in unethical conduct. Trainers shall be held exclusively liable for all expenses, losses and consequences arising out of such breach and violation of any law.

7. Platform User Reponsibilities.

• 7.1 Platform Users agree to conduct their own due diligence to verify the qualifications and experience of Trainers before using their fitness services.
• 7.2 Platform Users are advised to exercise caution and are warned that any fitness activity undertaken is done so at their own risk.
• 7.3 The Tin Hat Centre will not be responsible for any injuries, damages or losses resulting from interactions with trainers.

8. Payments and Fees

• 8.1 Trainers are required to pay a listing fee for bookings made through the platform.
• 8.2 Payment Processing is handled by a third-party provider and The Tin Hat Centre is not responsible for any problems related to payments and refunds.
• 8.3 Payment terms, refund policies and commission rate are given separately in this platform.

9.Dispute Resolution

• 9.1 Any disputes between Platform Users and Trainers shall be resolved by the parties involved.
• 9.2 The Tin Hat Centre is not obligated to intervene in case any dispute arises out of use of our platform, but may offer to mediate between the parties in their discretion.
• 9.3 The Tin Hat Centre is not liable for any financial or personal loss arising from disputes.
• 9.4 Any disputes between the Trainers and Platform Users against The Tin Hat Centre shall be resolved through Negotiation only.
• 9.5 The Tin Hat Centre’s Liability in any circumstance, shall not exceed the amount paid by the Platform User or Trainer to The Tin Hat Centre in the past 3 months.

10. Grievance Redressal Mechanism

• 10.1 If you have any complaints, concerns, or grievances regarding the Platform, Trainer services, or any other matter related to The Tin Hat Centre, you may submit a formal complaint by contacting us at: Email: joe@thetinhatcentre.co.uk
• 10.2 Trainers and Platform Users agree that any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions, including any dispute regarding their existence, validity, or termination, shall be resolved exclusively through binding arbitration.
• 10.3 Trainers and Platform Users expressly waive any right to bring or participate in any claim in any court or tribunal, including any class or representative actions.

11. Limitation of Liability

• 11.1 The Tin Hat Centre does not employ any Trainers nor guarantee the quality of their services.
• 11.2 The Tin Hat Centre is not liable for any loss, damage or injury caused by Trainer and Platform User interaction.
• 11.3 The Tin Hat Centre is not responsible for the accuracy of information used by Trainers for self-promotion.
• 11.4 The Tin Hat Centre is not liable for any Technical Issues or Service Interruptions on the Platform.

12. Address for Service of Notice

• 12.1 All legal notices, communications, and official correspondence related to these Terms and Conditions must be sent to this email address Email: joe@thetinhatcentre.co.uk (Notices shall be deemed received upon confirmation of receipt only).
• 12.2 This address shall be used for all legal matters, including service of legal documents, dispute resolutions, communications and official correspondence.

13. Governing law

• 13.1 These Terms shall be governed by the law of England and Wales. Parties to this contract agree to the exclusive jurisdiction of the courts of England and Wales.

14. Modification of Terms

• 14.1 The Tin Hat Centre reserves the right to update and modify these terms and conditions at any time. Continued use after modification shall constitute acceptance of the new terms and conditions.
